A man from northern California is fighting DUI charges after authorities only found caffeine in his system.
Back in August 2015, Joseph Schwab was allegedly driving erratically and cut off an unmarked car being driven by an officer from the California department of alcoholic beverage control in Solano Country, reports The Guardian.
Schwab’s attorney Stacey Barrett told the paper that he was given a breathalyzer test which showed that his blood-alcohol content level was at 0.00%. Schwab was then given a blood test, which came back negative forbenzodiazepines, cocaine, opiates, THC, carisoprodol (a muscle relaxant), methamphetamine/MDMA, oxycodone, and zolpidem.
A second lab then conducted a test and the only thing found in Schwab’s system was caffeine.
Schwab’s attorney has tried to get the case dismissed but, so far, that has been denied and now the case is scheduled to go to court on January 11.
Sharon Henry, chief deputy district attorney for Solano County, said in a statement that her office was “conducting further investigation in this matter”.
