Two San Diego nurses, who were caught on surveillance video fondling each other while caring for a 99-year-old stroke victim, pleaded guilty Monday to a felony charge of inflicting mental suffering on an elder.
The video showed 42-year-old Russel Torralba and Alfredo V. Ruiz, 43, engaging in sexual acts on multiple occasions in 2011.
At a preliminary hearing in 2014, defense attorneys argued that while the behavior was “inappropriate,” the female stroke victim was not neglected and wasn’t even aware of what was going on around her.
The judge in the case called their acts “shocking,” but did end up dismissing a count of lewd and lascivious behavior.
The pair will be sentenced March 30.
